TERMS OF SERVICE

1. GENERAL TERMS

1.1 Acceptance of Terms

These PitLaneLabs Terms of Service (“Terms”) govern your access to and use of the PitLaneLabs website, online store and related online services (collectively, the “Website”), including your purchase of Merchandise and registration for Events through the Website, as well as, where applicable, your purchase of Merchandise or registration for Events directly from PitLaneLabs at an authorized physical point of sale (“POS”) or other in-person location.

By accessing or using the Website, placing an order, registering for an Event or otherwise using the Website, or by making an in-person purchase or registration through an authorized PitLaneLabs POS or other in-person transaction channel, you agree to be bound by these Terms and the other documents comprising the applicable PitLaneLabs Legal Terms described in Section 1.7.

Certain provisions of these Terms apply specifically to use of the Website or online services and therefore may not apply to an in-person transaction where no use of the Website or online services is involved.

If you do not agree to these Terms, do not use the Website or make an in-person transaction through an authorized PitLaneLabs POS or other in-person transaction channel.

1.2 Definitions

For purposes of these Terms and, unless expressly defined differently in another document or required by applicable law, the following definitions apply:

“PitLaneLabs,” “PLL,” “we,” “us” or “our” means PitLaneLabs LLC.

“Website” means the PitLaneLabs website, online Store and related online functionality.

“POS” means an authorized PitLaneLabs point-of-sale system or other in-person transaction method used by PitLaneLabs to process purchases or registrations directly from customers.

“Merchandise” means physical goods offered for purchase by PitLaneLabs, whether through the Website, an authorized POS, or another authorized sales channel.

“Event” means any event, gathering, activity, experience, driving activity, track activity, automotive activity, community event or other in-person or online event or activity organized, hosted, sponsored, presented or made available by PitLaneLabs, whether participation is paid or free, and whether registration is required or optional.

“Participant” means any person who registers for, attends, enters, or participates in an Event.

“Driver” means a Participant who operates or controls a vehicle during an Event.

“Passenger” means a Participant who rides in, is transported by, or otherwise occupies a vehicle during an Event without operating or controlling the vehicle.

Unless expressly stated otherwise, references in these Terms to a Participant include Drivers and Passengers. Where a provision applies specifically to a Driver or Passenger, that provision will apply according to the Participant’s role in the applicable Event.

“Services” means the Website, Merchandise sales, Event registration and other services or functionality made available by PitLaneLabs through the Website, through an authorized POS, or through other authorized channels.

Unless expressly stated otherwise, capitalized terms used in the PitLaneLabs Privacy Policy or PitLaneLabs Returns & Refunds Policy have the meanings assigned to them in these Terms.

1.3 Eligibility

You must be legally capable of entering into a binding agreement to use the Website and purchase Merchandise or register for an Event.

Additional age, eligibility or other participation requirements may apply to particular Events, including requirements applicable specifically to Drivers or Passengers. You are responsible for reviewing and satisfying all requirements applicable to your participation before attending or participating in an Event.

1.4 Website and Services

PitLaneLabs may modify, suspend or discontinue any part of the Website or its online Services from time to time.

We do not guarantee that the Website or any particular feature will always be available, uninterrupted, secure or error-free.

1.5 Shopify Platform

The Website and online Store are powered by Shopify, which provides the e-commerce platform that enables PitLaneLabs to offer its Services online. Shopify may also provide point-of-sale functionality used by PitLaneLabs to process authorized in-person transactions.

Purchases made through the Website or through an authorized PitLaneLabs POS are transactions between you and PitLaneLabs. Shopify is not the seller of PitLaneLabs Merchandise or the provider of PitLaneLabs Events.

1.6 Accurate Information

You agree to provide accurate, current and complete information when using the Website, placing an order or registering for an Event, and to update such information where reasonably necessary to allow us to process your order, registration or communications.

1.7 PitLaneLabs Legal Terms and Related Policies

These PitLaneLabs Terms of Service, the PitLaneLabs Privacy Policy, and the PitLaneLabs Returns & Refunds Policy are intended to be read together and collectively constitute the principal PitLaneLabs Legal Terms governing the Website, Merchandise transactions, Event registration and related activities, including applicable transactions conducted through authorized PitLaneLabs POS or other in-person channels.

The separate presentation of these documents on the Website is for organizational and navigational purposes and does not mean that they are intended to be interpreted independently of one another.

The PitLaneLabs Terms of Service are the master document for the PitLaneLabs Legal Terms and establish the general contractual framework governing use of the Website, purchases of Merchandise, and registration for and participation in Events, including applicable in-person transactions.

The PitLaneLabs Privacy Policy governs PitLaneLabs’ collection, use, disclosure, retention, protection and other processing of personal information and provides applicable privacy notices, rights and choices.

The PitLaneLabs Returns & Refunds Policy governs returns, refunds, exchanges, Merchandise issues, Event cancellations, Event refunds and related remedies.

Unless a provision expressly states otherwise, capitalized terms defined in these Terms have the same meaning when used in the PitLaneLabs Privacy Policy or the PitLaneLabs Returns & Refunds Policy, except where the applicable document expressly defines a term differently or a different meaning is required by applicable law or the context.

If a provision of the PitLaneLabs Privacy Policy conflicts with these Terms with respect to privacy or data-protection matters, the Privacy Policy will govern to the extent necessary to comply with applicable privacy law.

If a provision of the PitLaneLabs Returns & Refunds Policy addresses returns, refunds, exchanges, Merchandise issues, Event cancellations or related remedies in greater detail than these Terms, the applicable provision of that Policy will govern with respect to that subject matter.

1.8 Privacy

PitLaneLabs’ collection and use of personal information is governed by the PitLaneLabs Privacy Policy, which forms part of the PitLaneLabs Legal Terms.

1.9 Cookies and Similar Technologies

The Website may use cookies, pixels, tags, local storage and similar technologies for functions such as security, authentication, preferences, analytics, performance, marketing and advertising.

The types of technologies used and the choices available to you may vary depending on the Website's functionality and applicable law.

Additional information concerning privacy, cookies, tracking technologies and applicable privacy choices is provided in the PitLaneLabs Privacy Policy.

1.10 Intellectual Property

The Website and PitLaneLabs content are protected by intellectual-property laws and are subject to Section 8 of these Terms.

1.11 User Content

You may have opportunities to submit reviews, comments, photographs, videos, feedback or other content.

You remain responsible for content you submit.

Additional provisions concerning photographs and video appear in Section 7 of these Terms.

1.12 Feedback

If you voluntarily provide PitLaneLabs with suggestions, ideas, recommendations, reviews, comments or other feedback concerning the Website, Merchandise, Events or our business (“Feedback”), you grant PitLaneLabs permission to use that Feedback for business purposes without compensation to you, including to improve, develop, promote or evaluate our offerings.

You represent that you have the right to provide the Feedback and that its use by PitLaneLabs as permitted by this Section will not knowingly violate the rights of another person.

This Section does not grant PitLaneLabs additional rights in photographs, videos or other media beyond those described in Section 7.

 

 

1.13 Personal Use and Unauthorized Resale

Merchandise purchased from PitLaneLabs, whether through the Website, an authorized POS, or another authorized sales channel, is intended for personal use unless PitLaneLabs expressly agrees otherwise.

You may not purchase Merchandise for unauthorized resale, redistribution or commercial exploitation.

PitLaneLabs may limit or cancel orders or deny a sale that it reasonably believes are intended for unauthorized resale or that exceed stated quantity limitations.

1.14 Third-Party Services and Tools

The Website may include functionality, applications, integrations or tools provided by third parties.

Such third-party services may be subject to separate terms and privacy policies.

PitLaneLabs does not control third-party services and is not responsible for their independent operation, content, availability or policies.

1.15 Third-Party Links

The Website may contain links to third-party websites or services.

Such links are provided for convenience and do not constitute an endorsement or guarantee by PitLaneLabs.

Your use of third-party websites and services is subject to their respective terms and policies.

1.16 Prohibited Uses

You may not use the Website:

• for unlawful purposes;
• to violate applicable laws or regulations;
• to infringe or misappropriate intellectual-property or other rights;
• to interfere with the Website's operation or security;
• to introduce malicious code or other harmful material;
• to collect information about other users without authorization;
• to impersonate another person or entity;
• to engage in fraudulent, abusive or deceptive activity;
• to engage in fraud, deception or other unlawful conduct;
• to use automated means to access or collect Website information except as expressly permitted; or
• to otherwise misuse the Website or PitLaneLabs services.

 

2. MERCHANDISE

2.1 Scope

This Section governs purchases of Merchandise through the Website and purchases made directly from PitLaneLabs through an authorized POS or other authorized in-person sales channel.

The PitLaneLabs Returns & Refunds Policy forms part of the PitLaneLabs Legal Terms and contains the applicable rules concerning Merchandise returns, refunds, exchanges, defective or damaged Merchandise and related remedies.

2.2 Product Descriptions and Variations

We make reasonable efforts to accurately describe and display Merchandise.

However, colors and appearance may vary depending on your device, screen settings and other factors.

Product descriptions, specifications, designs and availability may change from time to time.

PitLaneLabs may discontinue Merchandise or modify its designs, specifications or availability at any time.

2.3 Availability

Merchandise is subject to availability.

Displaying Merchandise on the Website does not guarantee that it will remain available.

2.4 Limited Drops

PitLaneLabs may offer Merchandise on a regular or limited basis.

From time to time, PitLaneLabs may release limited quantities of particular Merchandise as part of a limited-edition or limited-time “drop” (“Limited Drop”).

Limited Drops may be available only for a specified period, while supplies last, or until a stated quantity has been sold.

Unless expressly stated otherwise, a Limited Drop is not guaranteed to be restocked, reproduced or made available again.

PitLaneLabs may limit the quantity of Merchandise that may be purchased by a customer, household, account or order, particularly in connection with Limited Drops.

Merchandise displayed as part of a Limited Drop may sell out quickly. Adding an item to a shopping cart does not guarantee its availability or reserve the item for the customer.

PitLaneLabs reserves the right to correct inventory errors, pricing errors or other errors associated with a Limited Drop and, where necessary, to cancel an affected order and refund any payment received for the cancelled Merchandise.

2.5 Pricing, Taxes and Promotions

The price charged for Merchandise will be the price displayed at the time the order is submitted or, for an in-person POS purchase, the price displayed or otherwise quoted at the time of purchase, subject to any correction of pricing or technical errors.

Applicable sales tax, shipping charges and other charges will be displayed or calculated at checkout or otherwise disclosed at the time of purchase, as applicable.

Promotional offers may be subject to additional terms. If those terms conflict with these Terms, the specific promotional terms will control for that promotion.

PitLaneLabs may correct pricing or promotional errors and may cancel or adjust affected orders, with a refund of amounts paid for cancelled Merchandise where applicable.

2.6 Orders and Acceptance

When you submit an order through the Website, you are offering to purchase the selected Merchandise.

An order is not accepted until PitLaneLabs confirms acceptance.

PitLaneLabs may decline or cancel an order for legitimate reasons, including inventory limitations, pricing or technical errors, suspected fraud, payment problems, duplicate orders, quantity limitations or other circumstances affecting fulfillment.

If PitLaneLabs cancels an accepted order for Merchandise that you have already paid for, the amount paid for the cancelled Merchandise will be refunded to the original payment method, subject to applicable law.

For an in-person POS purchase, the transaction is completed when PitLaneLabs accepts the purchase and successfully processes payment, unless otherwise stated. Merchandise purchased through an authorized POS may be provided to you immediately following completion of the transaction.

Additional rules concerning cancellations and refunds are provided in Section 1.10 of the PitLaneLabs Returns & Refunds Policy.

 

2.7 Payment and Billing Information

You agree to provide accurate and complete payment and billing information and to update it as necessary where applicable.

Payment must be successfully processed before an order is accepted or fulfilled.

We may use third-party payment processors, subject to their terms and privacy policies.

2.8 Processing and Shipping

This Section applies to Merchandise orders that require processing and shipment and does not apply to Merchandise purchased and received directly at an authorized PitLaneLabs POS, except where otherwise stated.

You agree to provide an accurate and complete shipping address that is NOT a P.O. Box address. Please, note, that PitLaneLabs does not ship to P.O. Box addresses.

PitLaneLabs will process accepted Merchandise orders within a reasonable period after the order is placed.

Processing times may vary depending on Merchandise availability, order volume, Limited Drops, order details and other circumstances affecting fulfillment.

PitLaneLabs will make reasonable efforts to process and ship orders without unnecessary delay.

Once an order has been processed and shipped, delivery times will depend on the shipping method and carrier.

Shipping charges, if applicable, will be displayed or calculated at checkout.

2.9 Delivery Estimates and Carrier Delays

Delivery dates and timeframes are estimates and are not guaranteed unless expressly stated otherwise.

Carrier delays, weather, transportation disruptions, customs or other circumstances outside PitLaneLabs' reasonable control may delay delivery.

PitLaneLabs is not responsible for delays caused by circumstances outside its reasonable control, subject to applicable law.

2.10 Shipping Address

You are responsible for providing a complete and accurate shipping address.

If an order cannot be delivered because of an incorrect or incomplete address supplied by you, additional shipping costs or other charges may apply, and any available remedy will depend on the circumstances.

2.11 Lost or Damaged Shipments

If a shipment appears lost, damaged or materially delayed, contact support@pitlanelabs.com promptly after the issue becomes apparent.

PitLaneLabs will work with the carrier and evaluate available remedies in accordance with applicable law and the circumstances of the shipment.

For damaged or defective Merchandise, see Section 1.4 of the PitLaneLabs Returns & Refunds Policy.

 

3. EVENTS

3.1 Event Definition

For purposes of these Terms, an “Event” means any event, gathering, activity, experience, driving activity, track activity, automotive activity, community event or other in-person or online event or activity organized, hosted, sponsored, presented or made available by PitLaneLabs, whether participation is paid or free, and whether registration is required or optional.

3.2 Paid Registration

Where an Event requires payment, the applicable registration fee and any Event-specific terms will be disclosed before registration is completed.

Payment must be successfully processed for registration to be confirmed, unless otherwise stated.

Where a paid Event permits or requires Passengers, each Passenger may be required to register separately and provide the information and documentation required by PitLaneLabs.

3.3 Free Registration

PitLaneLabs may require registration for a free Event to manage capacity, logistics, communications, safety, eligibility or other operational requirements.

A free Event may therefore require registration even though no participation fee is charged.

Where a free Event permits or requires Passengers, each Passenger may be required to register separately and provide the information and documentation required by PitLaneLabs.

3.4 Event Refunds and Cancellations

Event registration and cancellation matters are governed by these Terms, the PitLaneLabs Returns & Refunds Policy, any Event-specific terms or registration terms presented to you, and applicable law.

The fact that Merchandise sales are final does not eliminate or restrict applicable refund rights for Events.

3.5 Free Event Cancellation

For a free Event, there is no participation fee to refund.

Registration by a Driver or a Passenger for a free Event does not create an entitlement to compensation merely because the Event is cancelled, postponed, modified, relocated or not attended.

3.6 Free Event Cancellation and Incidental Expenses

To the maximum extent permitted by applicable law, registration for a free Event does not create a contractual entitlement for the Event to take place on the originally announced date, at the originally announced location, or in the originally announced form.

PitLaneLabs is not responsible for incidental or consequential expenses incurred in connection with a free Event, including travel, accommodation, transportation, vehicle preparation or personal expenses, except to the extent liability cannot lawfully be excluded.

3.7 Participant Cancellation

Cancellation rights for paid Events are governed by the PitLaneLabs Returns & Refunds Policy and any applicable Event-specific terms.

Where a Driver and Passenger have separate registrations, cancellation by one Participant does not automatically cancel the registration of the other Participant unless otherwise stated in the applicable Event terms.

3.8 No-Show

Failure of a Driver, Passenger or other Participant to attend a registered Event does not necessarily entitle that Participant to a refund.

Any applicable refund rights are governed by the PitLaneLabs Returns & Refunds Policy and applicable Event-specific terms.

3.9 PitLaneLabs Cancellation, Postponement or Modification

PitLaneLabs may cancel, postpone, reschedule, relocate or materially modify an Event for reasons including weather, safety concerns, venue or track availability, operational considerations, insufficient registration, staffing, governmental requirements, force majeure or other circumstances that make the planned Event impracticable or unsafe.

If a paid Event is cancelled, postponed, rescheduled, relocated or materially modified, any refund, credit or other remedy will be governed by the Event-specific terms, the registration terms presented at purchase, the PitLaneLabs Returns & Refunds Policy, and applicable law.

To the maximum extent permitted by applicable law, cancellation, postponement, modification or relocation of a free Event does not create an entitlement to reimbursement for travel, accommodation, transportation, vehicle preparation or other incidental or consequential expenses.

3.10 Weather and Safety

PitLaneLabs may modify, delay, relocate or cancel an Event when weather, track, road, venue, vehicle, participant or other conditions create safety concerns or materially affect the planned Event.

3.11 Capacity and Registration Limits

PitLaneLabs may establish limits on Event attendance, registrations, vehicles, Drivers, Passengers or other categories of Participants. Registration may close when capacity is reached.

PitLaneLabs may also establish separate capacity limits for Drivers and Passengers.

Registration does not guarantee admission if applicable capacity, eligibility or safety requirements have not been satisfied.

PitLaneLabs may establish waitlists or other registration procedures and may limit the number of registrations per person or household.

3.12 Eligibility

Certain Events may have eligibility requirements relating to age, driver status, vehicle type, equipment, experience, licensing, insurance or other factors.

You are responsible for reviewing and satisfying applicable requirements before participating.

3.13 Registration Transfer

Registration may not be transferred to another person without the prior approval of PitLaneLabs, especially where an Event requires individual participant information or eligibility verification.

A Driver registration and a Passenger registration are separate where PitLaneLabs requires separate registration, and neither may be transferred without PitLaneLabs' approval.

3.14 Denial or Removal from Event

PitLaneLabs may deny admission to or remove a Participant, especially a Driver, from an Event where PitLaneLabs reasonably determines that the Participant:

• does not satisfy applicable eligibility requirements;
• has not completed required documentation;
• fails to follow Event rules or safety requirements;
• engages in unsafe, disruptive, abusive or unlawful conduct;
• appears impaired or otherwise presents a safety concern;
• provides inaccurate or incomplete information; or
• otherwise presents a reasonable safety, operational or legal concern.

This authority includes refusing or ending Passenger participation where Passenger conduct, condition, equipment or presence presents a safety concern.

Where appropriate, removal may occur without refund, subject to applicable law and Event-specific terms.

3.15 Participant Waiver & Release

Certain PitLaneLabs Events involve automotive, driving, riding, passenger, track or other activities that may involve inherent risks.

As a condition of registering for and participating in any PitLaneLabs Event, each Participant, including each Driver and Passenger, must review, complete and sign the PitLaneLabs Event Participant Waiver & Release before participating in the Event.

Each Passenger must complete and sign the PitLaneLabs Event Participant Waiver & Release individually, even if the Driver of the vehicle in which the Passenger rides has separately completed and signed a waiver.

A Participant's registration does not constitute completion or acceptance of the Participant Waiver & Release.

A Participant who does not complete and sign the required Participant Waiver & Release will not be permitted to participate.

The PitLaneLabs Event Participant Waiver & Release is available as attachment to these Terms of Service in Section 23. as below for review before registration and participation. As a condition of successfully registering for and participating in any PitLaneLabs Event, each Participant must review, complete and sign the PitLaneLabs Event Participant Waiver & Release before participating in the Event.

 

3.16 Third-Party Venue or Organizer Requirements

Events may take place at or involve third-party venues, tracks, organizers, instructors, service providers or other parties.

Additional requirements may apply differently to Drivers, Passengers and other Participants, including requirements relating to age, equipment, conduct, registration, waivers, insurance, vehicle access or safety. An Event may be subject to additional terms, waivers, rules, insurance requirements or other requirements imposed by a venue, track, organizer, sponsor or other third party.

You must comply with all applicable third-party requirements.

3.17 No Guarantee of Event Conditions

PitLaneLabs does not guarantee that an Event will occur exactly as described, that specific vehicles, Participants, instructors, venues or activities will be available, or that Event conditions will remain unchanged.

3.18 No Guarantee of Future Events

Past registration or participation does not create an entitlement to future Events.

PitLaneLabs may change, suspend or discontinue Events at any time, subject to applicable law and any specific contractual obligations.

 

4. EVENT RULES & PARTICIPANT REQUIREMENTS

4.1 General

All Participants (i.e. Drivers and Passengers, as applicable to their respective roles) must follow these Terms, all rules and Event-specific instructions, reasonable directions from PitLaneLabs personnel, and applicable laws and third-party venue, track or organizer rules.

4.2 Driver Requirements

This Section applies specifically to Participants who operate or control a vehicle during an Event.

Drivers must satisfy all applicable licensing, age, experience, vehicle, insurance and other requirements established for the Event.

4.3 Vehicle Requirements

Where a Driver uses a vehicle, the vehicle must satisfy applicable Event, track and venue requirements and be in a condition reasonably suitable for the activity.

Participants are responsible for their vehicle and its condition.

Passengers must comply with any vehicle-access, seating, restraint, equipment or other requirements applicable to their role unless expressly stated otherwise.

4.4 Safety Equipment

Participants must use required safety equipment and protective gear specified for the Event and must use it as instructed.

This may include safety equipment required specifically for Drivers or Passengers.

4.5 Inspection

PitLaneLabs or a venue, track or organizer may inspect vehicles or equipment where permitted and may impose Driver or Passenger safety requirements where permitted by applicable law, and/or deny participation if safety or eligibility requirements are not satisfied.

4.6 Conduct and Driving

Drivers must operate vehicles responsibly and in accordance with applicable Event requirements.

All Participants, including Passengers, must conduct themselves responsibly, follow instructions, and refrain from reckless, dangerous, aggressive, abusive, discriminatory, harassing or unlawful behavior.

4.7 Impairment

Participants may not participate while impaired by alcohol, drugs, medication or any other substance or condition that may materially affect safe participation.

PitLaneLabs may deny or end participation where it reasonably believes safety is compromised.

A Driver or Passenger may be denied or removed from participation where impairment or another condition reasonably creates a safety concern.

4.8 Instructions and Safety Decisions

Participants must promptly follow reasonable safety instructions from PitLaneLabs, venue personnel, track personnel, instructors or other authorized personnel.

Passengers must promptly follow reasonable safety instructions, including instructions concerning seating, restraints, vehicle entry and exit, protective equipment and conduct during vehicle operation.

PitLaneLabs, a venue, track or Event organizer may modify or stop an activity when reasonably necessary for safety.

4.9 Removal

PitLaneLabs, venue personnel, track personnel or other authorized personnel may remove a Participant from an Event when reasonably necessary for safety, compliance or operational reasons.

This includes removal of a Passenger whose conduct, condition, equipment or presence creates a safety concern.

4.10 Property

Participants are responsible for their personal property, vehicles and equipment.

Drivers are responsible for vehicles they own, provide or operate unless expressly stated otherwise.

PitLaneLabs is not responsible for loss, theft or damage except to the extent caused by liability that cannot lawfully be excluded.

4.11 Third-Party Rules

Participants must comply with applicable rules imposed by third-party venues, tracks, organizers, instructors and service providers, including Passenger-specific requirements.

4.12 Event-Specific Requirements

Individual Events may impose additional requirements relating to registration, age, eligibility, vehicles, equipment, insurance, conduct, safety or participation.

Event-specific requirements may apply differently to Drivers, Passengers and other Participants.

Additional requirements may be stated in Event registration materials, communications, waivers or other Event-specific documentation.

If an Event-specific requirement conflicts with these general rules, the Event-specific requirement controls for that Event to the extent permitted by law.

 

5. PARTICIPANT WAIVER & RELEASE

5.1 Purpose and Scope

Certain PitLaneLabs Events involve automotive, driving, riding, passenger, track or other activities that may involve inherent risks.

As a condition of participation in any PitLaneLabs Event, each Participant, including each Driver and Passenger, must complete and sign the PitLaneLabs Event Participant Waiver & Release before participating.

5.2 Separate Participant Document

The Participant Waiver & Release applies to each Participant individually, including each Driver and Passenger.

A Driver's execution of the Waiver does not satisfy the separate requirement that a Passenger execute the Waiver.

The PitLaneLabs Event Participant Waiver & Release is a separate document that applies to the Drivers’ and Passengers’ participation in the applicable Event and supplements these Terms and the applicable Event rules.

5.3 Mandatory Condition of Participation

Completion and signing of the PitLaneLabs Event Participant Waiver & Release is a mandatory condition of participation for every Participant, including every Driver and Passenger, in every PitLaneLabs Event.

5.4 Inherent Risks

Depending on the Event, risks may include collision; loss of control; mechanical, equipment, tire, brake, steering or suspension failure; road, track or surface conditions; debris; weather; actions or failures of other participants or third parties; emergency response; personal injury or death; and damage to vehicles or other property.

5.5 Voluntary Assumption of Risk

Participants acknowledge that participation may involve inherent risks and voluntarily assume the risks associated with their participation to the extent permitted by applicable law.

For a Passenger, this includes the risks associated with voluntarily riding in a vehicle operated or controlled by another person.

The standalone PitLaneLabs Event Participant Waiver & Release is intended to document the participant's acknowledgment and assumption of risks associated with participation to the fullest extent permitted by applicable law.

5.6 Third-Party Requirements

Participants may be required to execute additional waivers or comply with additional requirements imposed by venues, tracks, organizers or other third parties, including requirements applicable specifically to Passengers.

 

5.7 Legal Limitations

The PitLaneLabs Event Participant Waiver & Release is subject to applicable law and does not purport to release, waive or limit claims or liabilities that cannot lawfully be released, waived or limited.

The enforceability and scope of any waiver or release may depend on the particular Event and applicable law.

 

6. EVENT PARTICIPANT MEDIA

6.1 Event Photography and Recording

PitLaneLabs may photograph, film, record or otherwise document Events for purposes including event documentation, marketing, advertising, social media, promotional materials, editorial purposes and other legitimate business purposes, subject to applicable law and any applicable consent requirements.

6.2 Event Documentation

By attending or participating in an Event, including as a Driver, Passenger or other Participant, you and eventually your vehicle may appear incidentally in photographs, video recordings or other Event documentation.

6.3 Participant Images

Where applicable, PitLaneLabs may use a Participant's name, image, likeness, voice or other identifying characteristics in connection with Event documentation and promotional materials, subject to applicable law and any separate release or authorization that may apply.

6.4 User-Submitted Media

If you voluntarily provide photographs, videos or other media to PitLaneLabs, you represent that you have the necessary rights to provide them and grant PitLaneLabs the rights reasonably necessary to use the material for legitimate business purposes.

6.5 Third-Party Media

Events may be photographed or recorded by venues, sponsors, partners, other participants or other third parties.

PitLaneLabs does not control independent third-party media activities. Their collection and use of media may be governed by their own policies and permissions.

 

 

6.6 Privacy

PitLaneLabs will handle personal information associated with media in accordance with the PitLaneLabs Privacy Policy and applicable law.

 

7. ACCESSIBILITY

PitLaneLabs is committed to making the Website and Events reasonably accessible and to improving accessibility over time.

If you encounter an accessibility barrier or require reasonable assistance in connection with the Website or an Event, please contact support@pitlanelabs.com.

Accessibility accommodations may depend on the nature of the Event, venue and circumstances involved.

 

8. INTELLECTUAL PROPERTY & BRAND INFORMATION

8.1 Ownership

The Website and its content, including text, designs, graphics, photographs, logos, trademarks, service marks, product designs, videos, audio, layouts, compilations and other materials, are owned by PitLaneLabs, its affiliates or licensors, as applicable, and are protected by intellectual-property laws.

8.2 Permitted Use

Subject to these Terms, PitLaneLabs grants you a limited, non-exclusive, non-transferable, revocable permission to access and use the Website for your personal, lawful, non-commercial use and to view information and make authorized purchases or registrations.

8.3 Prohibited Use of Content

Except as expressly permitted by PitLaneLabs or applicable law, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, license or commercially exploit Website content or other PitLaneLabs intellectual property.

8.4 No Implied License

No license or right is granted by implication, estoppel or otherwise except as expressly stated in these Terms. Third-party trademarks and intellectual property remain the property of their respective owners.

 

8.5 Trademarks

PitLaneLabs names, logos, marks, slogans and other brand identifiers are trademarks or trade dress of PitLaneLabs or its licensors.

You may not use them without prior written permission except as permitted by law.

8.6 Merchandise Designs

Merchandise designs, graphics, logos, artwork, product names and related creative elements remain the property of PitLaneLabs or the applicable rights holder.

Purchasing Merchandise does not transfer intellectual-property rights in its design or branding to you.

8.7 User Content

You retain ownership of content you lawfully own and submit to PitLaneLabs, subject to any rights expressly granted through the applicable submission mechanism or separate terms.

You may not submit content that you do not have the right to use or that infringes another person's rights.

8.8 Third-Party Marks

Third-party names, logos and trademarks displayed on the Website belong to their respective owners.

Their appearance does not necessarily imply affiliation, endorsement or sponsorship.

8.9 Permission Requests

Requests for permission to reproduce or otherwise use PitLaneLabs intellectual property may be directed to support@pitlanelabs.com.

Permission must be obtained in writing where required.

 

9. DISCLAIMERS, LIABILITY AND GENERAL LEGAL TERMS

9.1 Disclaimers

To the maximum extent permitted by applicable law, the Website and its content are provided on an “as available” and “as is” basis.

PitLaneLabs does not guarantee that the Website will be uninterrupted, timely, secure, accurate, complete or error-free.

Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.

9.2 Limitation of Liability

To the maximum extent permitted by applicable law, PitLaneLabs and its owners, managers, members, employees, agents and service providers will not be liable for indirect, incidental, special, consequential or punitive damages arising from or relating to your use of the Website, purchase of Merchandise, whether online or in person, or registration for an Event.

To the maximum extent permitted by law, PitLaneLabs’ aggregate liability arising from your use of the Website, purchase of Merchandise, whether online or in person, or registration for an Event will not exceed the amount you paid to PitLaneLabs for the transaction giving rise to the claim.

Nothing in these Terms limits liability that cannot lawfully be limited or excluded.

Nothing in this Section is intended to replace, restrict or determine the scope of the separate PitLaneLabs Event Participant Waiver & Release.

9.3 Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless PitLaneLabs and its owners, managers, members, employees, agents and service providers from claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising from your unlawful use of the Website, violation of these Terms, infringement of another person's rights, or negligent, reckless or intentional misconduct.

Where applicable, this includes claims arising from a Participant's negligent, reckless or intentional conduct toward another Participant, including a Driver or Passenger.

Nothing in this provision requires indemnification to the extent prohibited by applicable law.

9.4 Suspension and Termination

PitLaneLabs may suspend or terminate access to the Website or refuse transactions or registrations where reasonably necessary to protect the Website, users, PitLaneLabs or third parties, or where you violate these Terms or applicable law.

9.5 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law applies.

 

 

9.6 Dispute Resolution

If a dispute arises concerning the Website, Merchandise or an Event, you agree to contact PitLaneLabs first at support@pitlanelabs.com and give us a reasonable opportunity to address the issue.

Unless a separate written agreement or Event-specific terms expressly provide otherwise, these Terms do not require arbitration or waive any rights to bring a claim in a court of competent jurisdiction.

9.7 Severability

If any provision of these Terms is held unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary, and the remaining provisions will remain in effect.

9.8 Waiver

PitLaneLabs' failure to enforce any provision of these Terms is not a waiver of its right to enforce that provision later.

A waiver must be express and applies only to the specific instance for which it is given.

9.9 Entire Agreement; PitLaneLabs Legal Terms

These Terms, the PitLaneLabs Privacy Policy, the PitLaneLabs Returns & Refunds Policy, and applicable Event-specific terms constitute the agreement between you and PitLaneLabs concerning the subject matter addressed by those documents, including applicable online and in-person transactions.

These documents are intended to operate together. The separate presentation of the Privacy Policy and Returns & Refunds Policy is for organizational and navigational purposes and does not mean those documents operate independently of these Terms.

The applicable Event-specific terms and the separately executed PitLaneLabs Event Participant Waiver & Release govern matters specifically addressed in those documents.

9.10 Assignment

You may not assign or transfer your rights or obligations under these Terms without PitLaneLabs' prior written consent.

PitLaneLabs may assign or transfer these Terms in connection with a merger, reorganization, sale of assets, change of control or other business transaction, or otherwise as permitted by law.

 

9.11 Changes

PitLaneLabs may update these Terms from time to time.

The updated version will be posted on the Website with a revised effective date where appropriate.

Material changes will be communicated in a manner required by applicable law.

Your continued use of the Website after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.

Updates to the PitLaneLabs Privacy Policy, the PitLaneLabs Returns & Refunds Policy, and the PitlaneLabs Event Waiver & Release will likewise be posted with an updated effective date where appropriate and will be governed by the applicable provisions of those documents and applicable law.

PARTICIPANT WAIVER & RELEASE

IMPORTANT — PLEASE READ CAREFULLY

This Participant Waiver & Release (“Waiver”) is a legal agreement between the undersigned participant (“Participant”) and PitLaneLabs LLC (“PitLaneLabs,” “PLL,” “we,” “us” or “our”).

Certain PitLaneLabs Events involve automotive, driving, track, riding, passenger, spectator-adjacent or other activities that may involve inherent and other risks, including the risk of serious bodily injury, property damage or death.

Every person who participates in an Event, including every driver and every passenger who rides in a vehicle during an Event, must complete and sign this Waiver before participating.

By signing this Waiver, you acknowledge that you have read and understand it, voluntarily choose to participate in the applicable Event, assume the risks described below, and agree to the release, waiver and other terms contained in this Waiver to the maximum extent permitted by applicable law.

This Waiver does not release, waive or limit any claim, liability or right that cannot lawfully be released, waived or limited.

1. AGREEMENT TO PARTICIPATE

I voluntarily desire to participate in an Event and understand that participation may involve automotive, driving, riding, passenger, track, road, venue, community or other activities.

I understand that participation may include, depending on the Event:

• driving or operating a vehicle;
• riding as a passenger in a vehicle;
• entering, exiting, approaching or being transported in a vehicle;
• riding in a vehicle while another person operates it;
• riding in a vehicle on public or private roads, closed courses, tracks or other surfaces;
• observing or being present around moving vehicles;
• vehicle demonstrations, activities, exhibitions or experiences;
• activities involving other Participants, vehicles, equipment, venues or third parties; and
• other activities associated with the Event.

I understand that PitLaneLabs may impose Event-specific rules, eligibility requirements, safety requirements, vehicle requirements, passenger requirements, waivers or other conditions of participation.

I understand that completion and signing of this PitLaneLabs Participant Waiver & Release is a mandatory condition of participation in every PitLaneLabs Event.

I understand that registering for an Event does not constitute completion or acceptance of this Participant Waiver & Release and that I will not be permitted to participate unless I complete and sign this document.

I agree to comply with those requirements as a condition of participating.

2. RELATIONSHIP TO PITLANELABS TERMS

This Waiver is a separate Event document and supplements the PitLaneLabs Terms of Service, the applicable Event rules and any Event-specific requirements.

The PitLaneLabs Terms of Service, PitLaneLabs Privacy Policy, and PitLaneLabs Returns & Refunds Policygovern the matters addressed by those documents.

This Waiver specifically governs my acknowledgment and assumption of risks and my release and waiver of claims relating to my participation in the Event, subject to applicable law.

If an Event is held at or involves a third-party venue, track, organizer, sponsor or other provider, I may also be required to sign additional waivers or comply with additional requirements imposed by that third party.

 

3. ACKNOWLEDGMENT OF INHERENT RISKS

I understand that automotive, driving, riding and related Event activities can involve inherent risks.

Depending on the Event, those risks may include, without limitation: collision with another vehicle, object, person or structure, loss of vehicle control, sudden acceleration, braking, turning or other vehicle movement, vehicle rollover, mechanical or equipment failure, tire, wheel, brake, steering, suspension, engine or drivetrain failure, road, track, course, parking-area or surface conditions, potholes, uneven surfaces, debris, standing water or other hazards, weather, temperature, visibility, wind, rain or other environmental conditions, actions, errors, negligence or failures of drivers, passengers, Participants, spectators, venue personnel or other third parties, negligent, reckless, unpredictable or improper conduct by another person, to the extent such risk is legally assumed or released, emergency response or delayed emergency response, inadequate or delayed medical assistance, injury resulting from entering, exiting or occupying a vehicle, sudden vehicle movement or unexpected maneuvering, contact with vehicle interiors, doors, windows, seats, restraints or other equipment, injury resulting from braking, acceleration, cornering, impact or other vehicle dynamics, fire, smoke or other vehicle-related hazards, exposure to noise, vibration, heat, cold, dust or other environmental conditions, personal injury, disability or death; and damage to personal or other property, damage to my vehicle or equipment or to others’, other risks inherent in or arising from participation in the Event.

I understand that these risks may exist even when reasonable precautions are taken.

I further understand that the specific risks associated with an Event may vary depending on the Event, vehicle, venue, weather, road or track conditions, other Participants and other circumstances.

4. PASSENGER-SPECIFIC ACKNOWLEDGMENT AND ASSUMPTION OF RISK

If I participate as a Passenger, I specifically acknowledge and agree to the following:

I understand that riding as a Passenger in a vehicle involves risks that may differ from those associated with operating the vehicle, and that I may have limited control over the vehicle, its speed, direction, braking, acceleration, maneuvering and other operating characteristics.

I understand that I may be unable to anticipate or control sudden braking, acceleration, turning, swerving, loss of traction, loss of control, collision or other vehicle movement, and that the driver's actions, judgment, experience, skill, attention and condition may affect my safety. I understand that I may be injured by the driver's actions or by the actions of another driver or third party, as well as by vehicle or environmental conditions.

I understand that the risks of being a Passenger may include, without limitation: sudden acceleration or deceleration, hard braking, sudden turning or maneuvering, loss of traction or vehicle control, collision, vehicle rollover, impact with another vehicle, object or person, movement within the vehicle, contact with vehicle components or the vehicle interior, injury caused by or despite the use of seat belts or other restraints, injury resulting from improper or unexpected positioning within the vehicle, injury caused by another occupant, vehicle mechanical or equipment failure, fire, smoke or other vehicle-related hazards, road, track or surface hazards, debris or objects entering or moving within the vehicle, weather or environmental conditions, actions or failures of the driver or other persons, and personal injury, disability or death.

I understand that wearing a seat belt or other required safety equipment does not eliminate these risks.

I agree to remain properly seated, use required restraints and safety equipment, follow all applicable Passenger instructions, and comply promptly with reasonable safety directions from the driver, PitLaneLabs, the Event organizer, venue personnel or other authorized personnel.

I will not intentionally interfere with the driver's operation or control of the vehicle. I will not distract the driver, obstruct the driver's visibility or controls, or engage in conduct that may reasonably compromise safe operation of the vehicle.

I understand that PitLaneLabs may prohibit or terminate Passenger participation if it determines that Passenger participation is unsafe or that applicable requirements have not been satisfied.

I voluntarily choose to participate as a Passenger with knowledge of these risks.

5. VOLUNTARY ASSUMPTION OF RISK

I understand the nature of the Event and the risks associated with my participation, and voluntarily choose to participate despite those risks.

To the fullest extent permitted by applicable law, I knowingly and voluntarily assume the risks inherent in and reasonably associated with my participation in the Event, including risks that may arise from my participation as a Driver, Passenger or other Event Participant.

My assumption of risk includes the risks specifically described in this Waiver as well as other risks that are reasonably apparent from the nature of the Event and my participation.

Nothing in this Section is intended to waive or release any liability that cannot lawfully be waived or released.

6. VEHICLE AND EQUIPMENT

If I operate or provide a vehicle, I acknowledge that I am responsible for ensuring that the vehicle satisfies applicable Event requirements and is in an appropriate condition and reasonably suited for the intended activity. I agree not to participate with a vehicle or equipment that I know, or reasonably should know, is unsafe or unsuitable for the Event.

I understand that PitLaneLabs, a venue, track or Event organizer may inspect vehicles or equipment where permitted and may deny participation if applicable safety or eligibility requirements are not satisfied. I understand that PitLaneLabs may not inspect, maintain, control or operate every vehicle involved in an Event.

If I participate as a Passenger, I understand that I may be riding in a vehicle owned, operated or provided by another person.

I agree to comply with all applicable vehicle and equipment requirements, and I will use seat belts, restraints, helmets and other required safety equipment as instructed.

I understand that mechanical failure or malfunction may occur without warning.

I understand that safety equipment reduces certain risks but does not eliminate the

possibility of injury or death.

7. COMPLIANCE WITH RULES AND INSTRUCTIONS

I agree to comply with: the PitLaneLabs Terms of Service, applicable Event rules, Event-specific instructions, reasonable directions from PitLaneLabs personnel, reasonable safety instructions from Event personnel, applicable venue or track rules, applicable laws and regulations; and additional requirements imposed by an Event venue, track, organizer, sponsor or other third party.

If I am a Driver, I agree to operate the vehicle responsibly and in accordance with all applicable requirements.

If I am a Passenger, I agree to remain properly restrained and to follow all applicable Passenger and safety instructions.

I understand that failure to follow Event rules or safety instructions may result in removal from the Event.

8. DRIVING AND PARTICIPANT CONDUCT

If I operate a vehicle during the Event, I agree to operate it responsibly and safely and to comply with all applicable Event rules and instructions, and Event-specific driving requirements. I will not engage in reckless, dangerous, aggressive, abusive, harassing or unlawful conduct.

I will not operate a vehicle while impaired by alcohol, drugs, medication or any other substance or condition that materially affects my ability to participate safely.

If I am a Passenger, I will not interfere with or distract the Driver and will follow applicable Passenger instructions.

All Participants must refrain from reckless, dangerous, aggressive, abusive, discriminatory, harassing or unlawful conduct.

I will not intentionally disregard safety instructions or knowingly create an unreasonable risk to myself or others, and I understand that PitLaneLabs may deny or terminate participation where it reasonably believes that this is necessary for safety (mine and of others), rule compliance, eligibility or other legitimate operational reasons.

9. RELEASE AND WAIVER OF CLAIMS

To the maximum extent permitted by applicable law, I release and discharge PitLaneLabs and its owners, managers, members, employees, agents, representatives, contractors, service providers, Event personnel and, where applicable, affiliated persons or entities involved in organizing or presenting the Event (collectively, the “Released Parties”) from claims arising from or relating to my participation in the Event to the extent such claims are based on risks that I have expressly assumed or claims that may lawfully be released under applicable law.

This release is intended to apply to claims for personal injury, illness, disability, death, property damage and other loss to the extent such claims may lawfully be released.

Without limiting the foregoing, I understand that the release is intended to apply to claims arising from the risks identified in this Waiver, including risks associated with driving, riding as a Passenger, being present around vehicles, vehicle movement, other Participants, Event conditions and other activities associated with the Event.

10. PASSENGER RELEASE

If I participate as a Passenger, I specifically acknowledge that the release in Section 9 applies to my participation as a Passenger, including risks associated with riding in a vehicle operated by another person.

To the maximum extent permitted by applicable law, I release the Released Parties from claims arising from or relating to risks I have voluntarily assumed as a Passenger, including risks associated with vehicle movement, acceleration, braking, turning, loss of control, collision, road or track conditions, vehicle equipment, actions of the Driver and actions of other Participants or third parties, to the extent such claims may lawfully be released.

I understand that this Passenger release does not mean that PitLaneLabs or any other Released Party is relieved of responsibilities that cannot lawfully be waived or released.

11. LIMITATIONS OF THE RELEASE

Nothing in this Participant Waiver & Release is intended to release, waive or limit any claim, liability, right or remedy that cannot lawfully be released, waived or limited under applicable law.

Nothing in this document is intended to release or limit liability for conduct that applicable law does not permit to be released or limited.

The enforceability and scope of this Waiver may depend on the particular Event, the nature of the activity, the relationship of the parties and applicable law.

12. MEDICAL FITNESS

I represent that, to the best of my knowledge, I am physically and mentally capable of participating in the Event in the capacity in which I intend to participate.

I understand that certain Events may involve physical exertion, heat, cold, stress, physical impact or other conditions that may affect my health or safety, and I will not participate if I know of a medical or other condition that makes my participation unsafe or inappropriate.

If I have a condition, limitation or accommodation need that may affect my participation, I understand that I should communicate with PitLaneLabs before participating so that reasonable accommodations or other appropriate arrangements can be considered where applicable.

I understand that PitLaneLabs is not providing medical advice or determining whether I am medically fit to participate.

 

13. EMERGENCY MEDICAL CARE

If I am injured or become ill during the Event, and require medical attention, I authorize Event personnel, emergency responders or other appropriate persons to obtain or arrange reasonable emergency medical assistance for me when circumstances reasonably require it.

I understand that PitLaneLabs does not provide medical services and that any medical treatment may be provided by independent third parties. I understand that emergency response and medical treatment may involve risks of their own.

I am responsible for my own medical expenses and insurance coverage except to the extent applicable law provides otherwise.

14. PERSONAL PROPERTY AND VEHICLE DAMAGE

I understand that participation in an Event may expose my vehicle, personal property, clothing, equipment or other belongings to damage, loss or theft.

To the maximum extent permitted by applicable law, I accept responsibility for my personal property and vehicle and release the Released Parties from claims for loss or damage to such property to the extent arising from risks I have assumed or claims that may lawfully be released.

If I am a Passenger, I understand that this provision applies to my personal belongings that I bring into or around a vehicle or Event.

Nothing in this Section releases liability that cannot lawfully be released or limited.

15. INSURANCE

I understand that I am responsible for maintaining any insurance required by applicable law, PitLaneLabs, the Event, the venue, track or other third party.

If I operate or provide a vehicle, I am responsible for maintaining any insurance required for that vehicle or activity.

If I participate as a Passenger, I understand that my participation may not be covered by the Driver's insurance or by any insurance maintained by PitLaneLabs.

I am responsible for determining whether my own insurance provides appropriate coverage for my participation.

16. THIRD-PARTY VENUES AND ORGANIZERS

I understand that an Event may be held at or involve a third-party venue, track, organizer, sponsor, instructor, service provider or other third party.

Such third parties may impose additional requirements, rules, waivers, releases, insurance requirements or eligibility requirements. I agree to comply with those requirements as a condition of participation.

 

17. PHOTOGRAPHY, VIDEO AND MEDIA

I understand that PitLaneLabs or third parties may photograph, record or otherwise document an Event on private and/or public property. As a Driver, Passenger or other Event Participant, I may appear in photographs, videos, recordings or other Event media.

PitLaneLabs may use Event documentation for operational, archival, promotional, marketing, editorial or community purposes, subject to applicable law and any applicable consent requirements.

Third parties, including venues, sponsors, partners and other Participants, may independently photograph or record Events, and their collection and use of media may be governed by their own policies and permissions.

18. RIGHT TO REFUSE OR END PARTICIPATION

PitLaneLabs, the Event organizer, venue, track or other authorized personnel may refuse, suspend or terminate my participation if reasonably necessary for safety, rule compliance, eligibility, failure to complete required documentation, failure to use required safety equipment, impairment, unsafe conduct, refusal to follow safety instructions, vehicle or equipment concerns, Passenger-related safety concerns, or other legitimate operational reasons.

I understand that PitLaneLabs may stop or modify an activity when generally reasonably necessary for safety.

I understand that PitLaneLabs may require me to leave an Event, or stop participating immediately when reasonably necessary for safety.

19. NO GUARANTEE OF EVENT CONDITIONS

I understand that Event conditions may change. Weather, venue or track conditions, venue or track availability, vehicle or equipment conditions, safety considerations, staffing, scheduling, governmental requirements, force majeure and other circumstances may require an Event to be modified, delayed, relocated, rescheduled or cancelled.

I understand that my signing this Participant Waiver & Release does not guarantee that an Event will occur in the originally announced form or as originally described.

20. GOVERNING LAW

This Participant Waiver & Release will be governed by applicable California law, except to the extent federal law or another applicable law controls.

21. SEVERABILITY

If any provision of this Participant Waiver & Release is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed to the minimum extent necessary, and the remaining provisions will remain in effect to the extent permitted by law.

 

22. FINAL ACKNOWLEDGMENT

I HAVE READ THIS WAIVER AND RELEASE CAREFULLY AND UNDERSTAND ITS TERMS. I UNDERSTAND THAT BY SIGNING IT I AM AGREEING TO ASSUME CERTAIN RISKS ASSOCIATED WITH MY PARTICIPATION IN THE EVENT IDENTIFIED ABOVE AND TO RELEASE AND WAIVE CERTAIN CLAIMS TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

IF I AM PARTICIPATING AS A PASSENGER, I UNDERSTAND THAT THIS WAIVER APPLIES SPECIFICALLY TO MY PARTICIPATION AS A PASSENGER AND TO THE RISKS ASSOCIATED WITH RIDING IN A VEHICLE OPERATED OR CONTROLLED BY ANOTHER PERSON.

I UNDERSTAND THAT I AM REQUIRED TO SIGN THIS WAIVER PERSONALLY AND THAT ANOTHER PARTICIPANT'S SIGNATURE, INCLUDING THE SIGNATURE OF A DRIVER WITH WHOM I MAY RIDE, DOES NOT SATISFY MY OWN OBLIGATION TO COMPLETE AND SIGN THIS WAIVER.

I SIGN THIS WAIVER VOLUNTARILY AND INTEND MY SIGNATURE TO CONFIRM MY AGREEMENT TO ITS TERMS.
